introducing a permit-based export procedure
for certain categories of goods from the territory of the Republic of Kazakhstan. The Order is applied within a pilot project and establishes the requirement
to obtain prior authorization from the authorized body
when exporting specified goods to CIS countries.
What Does Order No. 325-НҚ Regulate
The Joint Order is aimed at strengthening state control over the export
of goods with industrial, technological, and aviation applications.
The permit-based procedure applies exclusively to goods
listed in the appendices to the Order and is determined
based on the EAEU HS code.
Which Goods Are Subject to the Permit-Based Procedure
The Order contains three appendices with lists of goods:
- Appendix 1 — industrial goods;
- Appendix 2 — telecommunications and computer equipment,
components and materials; - Appendix 3 — aviation goods and components.
If the HS code of a good is included in one of the appendices,
its export is possible only with a permit.
Permit Issuance Timeline
The period for reviewing an application and issuing a permit is
up to 5 business days from the submission of a complete set of documents.
When planning export shipments, it is recommended to account for this timeline in advance
to avoid delays in customs clearance and cargo release.
Grounds for Refusal to Issue a Permit
In accordance with Clause 6 of Joint Order No. 325-НҚ,
a permit may be refused, including in the following cases:
- absence of a certificate of origin;
- if the country of origin is the United Kingdom, the United States,
or the European Union
(for goods specified in Appendices 1 and 2 to the Order).
These grounds require particular attention when preparing documents
and confirming the country of origin.
